The Domaine de la Glacière is an establishment of the company GEKKO, a Simplified Joint-Stock Company (SAS) with a capital of €100,000. The registered office is located at 80 Impasse Loic Nesty – 97 170 PETIT-BOURG, registered with the Pointe-à-Pitre RCS under the number 922 477 807.
These general terms and conditions apply to all bookings and transactions made at our establishment. By making a reservation or using our services, you agree to comply with and be bound by these conditions:
**General Terms**
These general terms of the seasonal rental agreement aim to define the conditions under which GEKKO rents the property to the client for the duration and under the conditions determined at the time of booking. Any reservation made by phone or through the website implies the consultation and acceptance of these general terms; the client's agreement is considered at the time of booking.
**Duration of Stay**
The client, signatory of this contract for a fixed duration, shall not, under any circumstances, claim any right to remain in the property beyond the agreed-upon rental period.
**Reservations**
Any reservation made by phone or through our website implies the consultation and acceptance of these general terms; the client's agreement is confirmed upon booking. To reserve a stay, you must provide accurate and complete information, such as your personal details, desired dates of stay, number of guests, etc.
Your reservation is confirmed only when you receive a confirmation email from us.

If the owner changes the property or if the tenant requests a change, it does not constitute a contractual modification. The number of people occupying the property and their identity will need to be specified at the time of the booking request. The use of the property is limited to these people and must not exceed the stated number for insurance reasons.
**Conclusion of the Contract**
The reservation becomes effective once the client has sent a deposit of 50% of the total rental amount upon booking confirmation.
If the client delays their arrival, except in cases of force majeure, they must inform the local contact at Domaine de la Glacière in advance and, in any case, respect the original end date of the rental. A delayed arrival, except in cases of force majeure, will be charged under the initial contractual conditions.
The rental agreement between the parties cannot, under any circumstances, benefit partially or entirely to third parties (whether physical or legal), unless written consent is provided by the owner. Any violation of this clause may lead to the immediate termination of the rental at the client’s fault, and the rental amount will remain with GEKKO.
The rental price includes all charges (water/electricity/air conditioning, free Wi-Fi, linens provided). No dispute about the price of the stay will be accepted once the contract is signed.
**Cancellation by the Client**
1. **Cancellation Before Arrival:**
The cancellation conditions are as follows:
- If the cancellation is made more than 30 days before the start of the stay, 100% refund of the booking amount.
- If the cancellation is made between 29 and 0 days before the start of the stay, no refund will be given.
If the client does not show up within 24 hours of the scheduled arrival date as specified in the contract, the agreement becomes void, and the owner may dispose of the accommodation. The deposit will also remain with GEKKO, which will request the payment of the remaining balance of the rental.
The **NON-CANCELABLE/NO-REFUND** rate requires full payment at the time of booking and is non-modifiable or cancellable.
2. **Shortened Stay:**
The rental price remains with the owner, and no refund will be given.
**Cancellation by SAS GEKKO**
In the event of a cancellation by SAS GEKKO, the full amount paid by the client will be refunded, except in cases of force majeure. In cases of force majeure (e.g., natural disasters, health emergencies, etc.), no compensation will be paid.
**Arrival / Departure**
Arrivals are from 3:00 PM onwards. The keys will be available in a key box. You will receive the necessary instructions for a self-check-in 48 hours before your arrival; check-in will be done the next morning between 9:00 AM and 12:00 PM with our caretaker. Departures must be by 10:00 AM at the latest.
However, a late departure option is available, subject to availability, for a fee of €50 for a 2:00 PM departure and €70 for a 5:00 PM departure.
Upon departure, clients must return the property in a clean condition: dishes cleaned and put away, cupboards and fridge emptied, microwave and fridge cleaned, trash disposed of in the designated exterior bins. A €35 deduction from the security deposit will be made if this is not adhered to.
For organizational reasons, the arrival and departure times must be respected.
**Payment of the Balance**
The balance of the stay must be paid 30 days before arrival by credit card directly to SAS GEKKO or through the reservation website, cash, or check. If the reservation is made within 30 days of the arrival date, the full amount must be paid at the time of booking.
**Inventory**
The property is rented fully furnished and equipped. Linens are provided (sheets, towels, bath mats, tea towels, fouta); a hairdryer is available in the bathroom.
An option for changing linens and towels can be selected at the time of booking.
For stays of more than 7 days, an intermediate cleaning is mandatory at a cost of €50.
The property has a fully equipped kitchen (fridge, freezer, stove, microwave, Nespresso coffee machine, toaster, kettle, tableware, and wine glasses). It is also connected (Wi-Fi, smart TV, Bluetooth speaker...) with a hairdryer.
Free access to a self-service laundry room (washing machine, dryer) is available for stays of more than 5 days.
The cleanliness of the accommodation upon arrival must be verified.
Cleaning is the client's responsibility during the rental period, while the owner will handle the end-of-stay cleaning.
Repairs required due to negligence or poor maintenance during the rental period will be charged to the client or their family. No replacements for items other than identical ones will be accepted at the client's initiative.
**Security Deposit**
A security deposit of €500 must be pre-authorized by the client with SAS GEKKO no later than 48 hours before arrival.
It is the client's responsibility to ensure this pre-authorization has been requested at the time of booking, and if not, to arrange it directly with SAS GEKKO (e.g., Booking.com will send a message in this regard to which the client must respond).
Failure to pay the deposit will result in refusal of entry to the property.
The deposit will be refunded by canceling the pre-authorization within 7 days after the rental ends, provided no damage is found within 48 hours of the client's departure. If damage is found, the client will be responsible for repair costs and replacement of lost, damaged, or deteriorated items.
In addition, SAS GEKKO reserves the right to charge and deduct from the security deposit for any additional cleaning hours required for excessive mess.
**Tourist Tax**
The tourist tax must be paid 48 hours before arrival. For bookings made through Booking or Airbnb, the tourist tax is €1 per person per day for individuals over 18 years old. This fee is mandatory and contractual.
**Use of the Property**
The client must ensure the peaceful nature of the rental and use it in accordance with its intended purpose. Children, whether part of the rental or visitors, are the sole responsibility of their parents or accompanying adults.
The client agrees to maintain silence between 10:00 PM and 7:00 AM.
GEKKO is committed to environmentally responsible consumption to preserve our beautiful island, so please use air conditioning only when the doors and windows are closed, and turn it off when not in use.
**Capacity**
This contract is established for a maximum capacity of guests, which must not be exceeded. If the number of guests exceeds the capacity, the owner may refuse additional guests. Any modification or termination of the contract will be considered as the client's initiative.
**Pets**
For hygiene reasons and to respect all guests, pets are not allowed in the residence. If this clause is violated, the owner may refuse the stay, and no refund will be issued.
**Insurance**
The client is responsible for any damages caused during the stay and must have insurance coverage for vacation rentals. Failure to provide insurance may result in claims for damages. The owner will ensure the property is covered against rental risks. The client must notify the owner within 12 hours of any incident.
**Property Visits**
The client cannot refuse visits by the owner or their representative when requested.
**Smoking**
Smoking is strictly prohibited inside the property. A penalty of €150 will be applied if it is found that the client has violated this ban.
**Swimming Pool**
The property includes a shared swimming pool, maintained weekly. Clients must not interfere with the pool machinery.
A safety barrier meeting current regulations is installed around the pool. However, clients must take all necessary precautions, particularly when staying with children, whom they must supervise at all times.
The security system does not replace the vigilance of responsible adults, who must provide constant and active supervision. Children should be equipped with flotation devices (appropriate rings, armbands, float suits...) during swimming.
The client releases SAS GEKKO from any responsibility in case of an accident involving themselves, their family, or their guests. A shower is mandatory before entering the pool. The use of sunscreen is discouraged, and sun protection equipment like rash guards and hats is recommended. Sunscreen oils are prohibited in the pool.
**Nuisances**
SAS GEKKO cannot be held responsible for irregularities or lack of enjoyment of water, electricity, phone, or Wi-Fi services and declines responsibility for any inconvenience not caused by its fault. Similarly, private or public works, construction, or events will not be grounds for complaint against SAS GEKKO.
The client agrees to allow maintenance staff for garden, pool, and property upkeep as necessary.
**Disputes**
Any claims regarding the rented property must be made within 48 hours of entering the premises by registered letter to the owner, accompanied by supporting documents. Claims made after this period will not be considered. In case of disputes, the Commercial Court of Pointe-à-Pitre shall have exclusive jurisdiction.
**Personal Data**
Certain information collected via our website (www.domainedelaglaciere.com) is processed for client and prospect file management in connection with booking contracts. The recipient of the data is SAS GEKKO. In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and delete your personal data at any time.
